1. Definitions

You, the Customer a person or company buying Products from us.

Consumer a private person buying Products for private use. If you are a Consumer, please find your specific rights and exceptions in Section 10.

Software computer operating systems, middleware or applications.

Product computers built to specification, components and peripherals purchased from us.

2. Quotations/Orders/Contract

Specifications of computers consist of the hardware and software specified by the customer, no additional software or hardware should be presumed included unless specifically ordered or otherwise stated on the order page, this includes floppy drives, CD/DVD burning software. We reserve the right to change Products (incl. 3rd Party Products) at any time but we guarantee equivalent or superior functionality and performance.

3. Price & Payment Terms

Prices quoted by us are normally inclusive of value added tax or any similar taxes, levies or duties. The costs of carriage, delivery, packaging and insurance are excluded from the product price.

Full payment must be received prior to despatch, we will begin processing your order once cleared funds have been received.

4. Delivery/Title/Risk

The delivery period stated is an approximate guideline and is not the basis of the contract unless otherwise stated.

We are entitled to deliver orders in instalments in the event that certain components are out of stock

The place of delivery is stated in the Order Confirmation, in the event that the order has been dispatched and requires to be redirected to a different address, a £15 charge applies.

Risk of the loss of the goods passes to you on delivery.

When signing for delivered goods you must be satisfied that the goods have arrived in undamaged condition, if this is impractical the delivery note must be signed for as “unchecked”, otherwise transit insurance would be void and the customer would be responsible for repair costs. When you receive Product you must inspect it for any defects or non-conformity within 3 days. After this period the goods are conclusively deemed as accepted, and claims of transit damage cannot be upheld.

5. Software

Software not owned by us is supplied subject to licence and warranty of the Software licensor. We enclose the Software licence that you require with the Product where necessary; you must comply with that licence.

6. Warranty

We warrant that goods will at the time of delivery be free from defects in workmanship and materials and correspond in all material respects with the relevant product specification. We guarantee that the Goods (excl. peripherals) will be free from defects for 12 months from delivery. If any goods do not conform to this warranty then we will at our option either remedy the defect in question, replace the defective Goods as like for like or refund the price of the defective Goods in extreme circumstances where neither repair nor replacement is available to us. The first 12 months of warranty cover parts and labour, any additional Warranty selected will cover labour only and the customer is responsible for replacement parts.

The warranty period commences on the next day after delivery or collection.

The provision of the service under this warranty will be on the base unit only and does not include monitors or other peripherals, which are covered by separate manufacturers warranty agreements.

In normal circumstances we provide return-to-base warranty. In the event that a computer must be returned to us. Unauthorised returns will be rejected. Our Collect and Return period as noted in the warranty drop down within the products is applicable to UK Mainland only.

Should the unit need to be returned for repair it is the customers responsibility to ensure that it is adequately packaged, any damages in transit are not covered by warranty.

Any repairs or parts supplied or other work carried out which are found to be outside the terms of this warranty will be charged to the purchaser, and will be payable at the point of service.

The purchaser must ensure the environmental and power supply conditions are suitable for the equipment, and that the equipment is cared for and maintained in accordance with the manufacturers recommendations and instructions.

Although we do not apply warranty stickers, certain internal components such as graphics cards will have manufacturer warranty also, this warranty, although separate to ours is void if the warranty sticker is broken and/or certain components have been upgraded by the user, and we have reason to believe this has had a direct effect on the failure of a part supplied by us. In this instance the customer would be responsible for labour costs.

It is the purchaser’s responsibility to ensure that adequate back-ups of all applications, operating systems and data are maintained. In the event of fault emanating from a manufacture or design fault, it may be necessary for the machine to be returned to the manufacturer for fault diagnoses, repair and testing. Depending on the geographical location of this manufacturer turnaround can be anywhere between 30-90 days.

Monitors are governed by separate manufacturer’s warranty. All warranties of our products are on hardware only – no warranty is given on software packages or driver issues. Although we will provide ongoing support should you require any advice.

*NOTE* On Graphics cards used for mining, if a fault is to develop during the warranty period, we would honor this however we would rely on the manufacturers repair process and would not be able to immediately replace due to the RMA process and the known fact that mining does damage graphics cards.

Please note due to the custom nature and the inherant risk of shipping when selling your product on to a third party, our warranty is not transferable – however all component parts are brand new and covered by the manufactuers warranty *Please refer to the manufacturer for their terms and conditions with regards to warranty.

*Free gifts are exempt from warranty and repairs*

Exclusions

Software and Operating Systems. Breakdowns or failures arising from any external influences such as misuse, neglect, excessive wear to the equipment and other external influences such as, but not limited to, poor environmental conditions, electrical power surges, power failure, the use of incompatible or uncertified accessories or media (pirate copies) and the effect of computer viruses.

Any issues not notified to us that have spanned a period of more than 3o days and caused damages to the system on the whole such as thermal issues, in the event that the customer is aware of such issues but not taken any steps to contact us to resolve may lead to the warranty being exlcuded on such parts as this is considered to be neglect. Please notify us in the event of any issues as one part failing (such as CPU cooler) and continuing to use the computer can cause consequental damages to other parts within the PC.

The replacement of any parts classed as consumables, such as floppy disks, tapes, magnetic media of any type and batteries.

Any consequential loss or liability of any kind to the purchaser caused by any decisions or actions made during or after the period when the services were delivered.

Indirect or inconsequential losses: We do not accept liability for any indirect loss, loss of data, loss of income or profit, loss or damage to goodwill, loss or damage to property and or loss/costs of third parties arising out of the use of the website or the goods or services or as a result of any failure of any goods purchased from us.

We operate an “open case” policy, which means our customers are fully entitled to open the units and alter them as they deem fit – however, if it has been opened within the initial 30 days of receipt, this will void the right to 30 days returns for a full refund and from that point onwards be subject to warranty. If damages are found to be made as a consequence of alterations this may be chargeable when in for repair.

Although we will not refuse a repair if reasonable care has not been shown during the possession of the device then we will exercise our right to void warranty subject the chargeable repairs from that point onwards.

Custom builds may only be returned if they are not as described, any defects however, should they occur, will be resolved within warranty and lifetime support applies custom systems.

*Fanless PC’s – Due to the complex nature of our fanless systems and the settings applied to them to ensure they operate without issue, whilst we operate an open case policy – any works carried out without notifying us prior to discuss their suitability may result in voiding the warranty. Please contact us first prior to altering your Fanless PC so that we can provide information on how to do so in such a manner that it will not famage the PC or its ability to operate. *This does not include simple tasks such as adding additional storage or RAM but the altering of the system itself and or the settings applied to the system within the BIOS.

7. Force Majeure

We are not liable for delays in performance (incl. delivery or Service) caused by circumstances beyond its reasonable control; examples include strikes, terrorist acts, war, supplier / transport / production problems, exchange fluctuations, governmental or regulatory action and natural disasters. If this lasts more than 2 months, this Agreement may be terminated by either party without compensation.

8. Data Protection

Your data will be held and/or transferred in strict accordance with the applicable data protection laws. Your details will not be transferred to third-parties.

9. Repair

Turnaround varies from 3-10 working days for returned PCs. We will contact you once the PC is tested and will inform you whether or not you are entitled to a full refund.

If a problem with the PC is reported within 30 days of receipt we will arrange collection and re-delivery free of charge. A collection and re-delivery charge will apply if no fault was found by our technicians or if the fault is software-related.

A collection and re-delivery fee applies for PCs within the warranty period returned after 30 days of receipt.

A return shipping fee will be charged for units outside of policy.

Returned PCs must be securely packaged, preferably in their original box. In the event that a PC is returned in non-original packaging, we cannot be held responsible for the damage during transportation to our workshop and during transportation back to the customer, and a courier claim may be void.

10. Refunds

If the PC is found to be faulty within the first 30 days of receipt we must be notified in written form within 30 day of receipt to be eligible for a refund. Once the PC has been returned to base and the fault has been confirmed we will process refund ASAP and in any case within 30 days of cancellation. For a full refund to be processed the goods must be returned in their original condition, along with all CDs, manuals and packaging. If the PC is found not to be faulty or is outside the scope of our warranty, then you may be charged for collection and re-delivery or a cancellation charge may apply. For this reason, please make sure that the faults you have diagnosed are not due to incompatibility or software issues.

The “cooling off” period outlined in Distance Selling Regulations (DSR) state that a customer has the right to cancel the order without giving a reason up to 7 working days starting the day after delivery. The consumer has a duty of care for the products during the cancellation period and the products should be returned at the expense of the buyer. Any software delivered is excluded from the “cooling off” period.

Returned PCs must be securely packaged, preferably in their original box. We recommend double boxing the items to prevent any damages in transit. In the event that a PC is returned in non-original packaging or irresponsibly packaged, we cannot be held responsible for the damage during transportation to our workshop and during transportation back to the customer, and a courier claim may be void.

Please note in order to accept a unit we will need all accounts removed from the system prior to return as we will be unable to access a device that is password locked to reset it.

Units returned outside of our 30 day returns period, we reserve the right to refuse the return or charge a restocking fee up to £200 per unit, the customer will be given the option however to retain the unit in place of payment.

Goods made to a customers specificaton – (Not comprising of products purchased via the website) In the event of a singular or bulk purchases made to customers specifications, comprising of items not currently in our stock, due to our inability to return these components ourselves we are unabe to cancel such orders however they are still subject to warranty and repairs in the normal fashion.

Please note returned PC’s and Components that are ordered in error or simply not wanted, in the event these have already been shipped will be refunded exlucing the initial shipping fee – in the event of failed hardware or errors the refund will be processed in full.

11. Jurisdiction

English law and the exclusive court jurisdiction of the English courts will apply to this Agreement

12. Miscellaneous

We may subcontract, assign or transfer our obligations or rights to a competent third party whether in whole or in part. You may not assign or transfer any of your obligations. All notices must be in writing (by hand, email, fax or 1st class post deemed delivered 48 hours after posting) and sent to a representative of either party. It is your responsibility to ensure compatibility of any goods offered for sale by us and with and software packages or components within your system or any other goods offered for sale by us.

Returns: After acceptance of a return all units must be recieved within 7 days of confirmation otherwise they will need to be reapproved subject to being within the alloted 30 days – giving a total of 37 days for returns, outside of this period all units are subject to warranty.

We do not store customer credit card details, nor do we share customer details with any 3rd Parties.
